1. TO ENTER: No purchase necessary. Complete an entry form on the Buzzplant website, located on the Internet at the following domain name: http://www.buzzplant.com (the "website"). Entries must be received by 11pm Central Time on November 20, 2002. Sponsor assumes no responsibility for any human error which may occur in the processing of entries, or for late, lost, misdirected, damaged, incomplete, illegible or postage due entries. With regard to entry via the Internet, Sponsor assumes no responsibility for incomplete, lost, late, damaged, illegible or misdirected e-mail, for technical hardware or software failures of any kind, lost or unavailable network connections, lost, delayed or corrupted data transmitted by any participant, or failed, incomplete, garbled or delayed computer transmission which may limit a participant's ability to participate in the sweepstakes. Sponsor reserves the right to cancel or modify the sweepstakes if fraud or technical failures destroy or corrupt the integrity of the sweepstakes as determined by Sponsor, in its sole discretion. If the sweepstakes is so canceled, only prizes to which any and/or all announced winners are entitled as of the date of cancellation will be awarded. Correspondence relating to entry in the sweepstakes will not be answered or acknowledged. Limit one entry per e-mail name/address. In the event of a dispute regarding the identity of a person submitting an online entry, the online entry will be deemed submitted by the holder of the respective online e-mail account. If multiple entries are received from one person or e-mail name/address, only the first entry will be considered and subsequent entries will be disqualified.
2. ELIGIBILITY: Sweepstakes open to all U.S. residents (other than residents of Rhode Island, New York, Florida or other states where sweepstakes over $500 is prohibited by law), except employees, families, officers, directors, agents, representatives and the immediate families of Furious? Records, Inc., Buzzplant, EMI CMG, EMD, all other vendors and participants involved with this contest, and their parent companies, subsidiaries, retailers and advertising and promotion agencies. Winner must be 18 or older as of the date of entry. Sweepstakes void where prohibited by law. Contest sponsored by Furious? Records, Inc.
3. HOW TO WIN: The winner will be drawn at random from all eligible entries. Winner drawn on or about November 21, 2002 by Furious? Records, Inc., whose decisions concerning all matters related to this sweepstakes are final. Winner will be notified by phone. If prize is undeliverable, that prize will be considered forfeited. If the winner cannot be reached or if winner fails to claim the prize by NOON on November 25, 2002, or if winner refuses the prize, an alternate winner will be selected based on a second random drawing.
4. HOW TO CLAIM YOUR PRIZE: To receive prize, winner will be required to execute forms confirming eligibility and compliance with Rules and Furious? Records, Inc., Buzzplant, EMI CMG, EMD, all other vendors and participants involved with this contest of any liability relating to activities in connection with prize. Winner's name will be posted on the Buzzplant website. Entries will become the exclusive property of Furious? Records, Inc. and will not be returned. Winner will receive prize within 1-2 weeks after Sponsor's receipt of all eligibility/release forms. Flights must be confirmed and purchased by November 27, 2002.
5. PRIZES: One (1) prize. Odds of winning prize depends upon total number of eligible entries received. Prize includes two (2) round trip airline tickets to London, hotel accommodations for two (2) people for three (3) nights, December 18th, December 19th and December 20th, and spending money in a total amount of $400. Approximate retail value of prize is $4000. No substitutions, transfers or assignments allowed. Sponsor reserves the right to substitute a comparable prize of like or greater value for any reason.
6. PRIZE RESTRICTIONS: Alternate prizes or cash will not be offered in lieu of prize described above. Prize may not be substituted, transferred, or exchanged.
7. DISCLAIMERS: All federal, state and/or local rules and regulations apply; void where prohibited by law; winners are responsible for any and all taxes associated with the acceptance of their prize. Winners accept all liabilities for use of prize. The above-named companies accept no liability or responsibility for damages, losses or injuries of any kind resulting from acceptance or use of any prize. Winners grant the above-named companies and Sponsor permission to use their names and likenesses for advertising and promotional purposes for this and similar promotions connected with this sweepstakes without further compensation except where prohibited by law.
The website and the webpages upon which the details of the sweepstakes are contained, as well as any associated software, are provided on an "as is" basis without warranties of any kind, either express or implied. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. In no event will Sponsor, or any person or entity associated with the sweepstakes or the associated software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the participation in or inability to participate in, the sweepstakes.
8. WINNER'S NAME: For the name of the winner, send a self-addressed stamped envelope, after November 21, 2002 and before February 21, 2003 to Furious? Records, PO Box 681865, Franklin, TN 37068-1865. Winner's name will be available on-line at contest site.
9. VENUE AND JURISDICTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and the Sponsor in connection with the sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States, without giving effect to any choice of law or conflict of law rules or provisions (whether of the United States, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the United States. All claims, disputes or disagreements which may arise out of the interpretation, performance or breach of these Official Rules shall be submitted exclusively to the jurisdiction of the state courts or Federal District Courts located in the state of residence of the Sponsor (or, if more than one state is involved, the state that shall be designated by the Sponsor).
